Website Terms & Conditions
Effective date: October 2026 Last updated: October 2026
Welcome to the website of Empowering Counseling ("Empowering Counseling," "we," "us," or "our"), operated by Bianca Bennett, in Phoenix, Arizona. By visiting or using [www.empoweringcounselingaz.com] (the "Site"), you agree to these Terms & Conditions. If you do not agree, please do not use the Site.
1. Not Emergency Care
If you are in crisis or believe you may be in danger, do not use this Site to reach us. Call 911, go to the nearest emergency room, or call or text 988 (the Suicide & Crisis Lifeline), available 24/7. We do not monitor website forms, email, or text messages in real time, and we cannot respond to emergencies.
2. Informational Purposes Only
The content on this Site, including blog posts, articles, social media links, and resources, is provided for general educational and informational purposes. It is not medical, psychological, or mental health advice, diagnosis, or treatment, and it is not a substitute for care from a qualified professional who knows your circumstances. Do not delay or disregard professional advice because of something you read here.
3. No Therapist-Client Relationship Through the Site
Visiting the Site, sending a message, submitting a form, or booking a consultation call does not create a therapist-client relationship. A therapist-client relationship begins only after we have both agreed to work together and you have completed and signed our intake paperwork, including informed consent. Until then, please do not send detailed clinical or personal health information through the Site, email, or text.
4. Fit, Eligibility, and Scope of Services
Empowering Counseling offers individual counseling in person in Phoenix, Arizona and by secure telehealth. We may not be the right fit for every person or concern, and we may decline to offer services or refer you elsewhere when another provider or level of care would better serve you. Telehealth services are limited to clients located in Arizona at the time of the session . Services are for adults and adolescents.
5. Communications
Email, text messaging, and website forms are not fully secure or confidential. By contacting us by these methods, you acknowledge the risk that others may access your messages. Please limit communications to scheduling and general logistics. We aim to respond within 2 business days during our office hours (Tuesday through Thursday, 8:00 a.m. to 5:00 p.m. Arizona time), but we cannot guarantee a response time.
If you provide your phone number and ask us to text you, you consent to receive scheduling and administrative texts from us. Message and data rates may apply. You can opt out at any time by telling us or replying STOP.
6. Scheduling, Fees, and Cancellations
Session fees, payment methods, insurance or superbill information, sliding-scale availability, and our late-cancellation and no-show policy are set out in your client agreement and intake paperwork, which govern once you become a client. Nothing on this Site is a binding offer of services at a particular price. Fees may change with notice. [Optional: brief summary of cancellation policy, e.g., "24 hours' notice is required to avoid a late-cancellation fee."]
7. Testimonials and Results
Any descriptions of therapeutic approaches on this Site (for example, EMDR, somatic awareness, internal family systems, attachment-focused work, and dialectical behavior therapy) are for general information. Therapy outcomes vary from person to person, and we make no promise or guarantee of any specific result. [If you ever add client testimonials, confirm they comply with Arizona Board of Behavioral Health Examiners rules and professional ethics codes; testimonials from current or former clients are restricted in many ethics codes.]
8. Intellectual Property
All content on the Site, including text, graphics, logos, photography, layouts, and downloadable materials, is owned by or licensed to Empowering Counseling and is protected by copyright, trademark, and other laws. You may view and print content for your personal, non-commercial use. You may not copy, reproduce, republish, distribute, modify, or create derivative works from any part of the Site without our prior written permission. Photography on the Site is used under license from its creator and may not be reused.
9. Acceptable Use
You agree not to: use the Site for any unlawful purpose; attempt to gain unauthorized access to the Site, its servers, or our systems; introduce viruses or harmful code; scrape or harvest data from the Site by automated means; submit false, misleading, or harassing content; or impersonate another person.
10. Third-Party Links and Services
The Site may link to third-party websites, scheduling platforms, telehealth platforms, podcasts, social media, or resources. We do not control and are not responsible for their content, privacy practices, or availability. A link is not an endorsement. Your use of third-party services is governed by their terms and policies.
11. Disclaimer of Warranties
The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, completeness, fitness for a particular purpose, or uninterrupted or error-free operation, to the fullest extent permitted by law.
12. Limitation of Liability
To the fullest extent permitted by law, Empowering Counseling and Bianca Bennett will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of, or inability to use, the Site or reliance on its content. This section does not limit any liability that cannot be limited by law, and it does not apply to professional services provided under a signed client agreement, which are governed by that agreement and applicable professional standards.
13. Indemnification
You agree to indemnify and hold harmless Empowering Counseling and Bianca Bennett from claims, damages, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or your violation of these Terms.
